The National Human Rights Commission has taken suo motu cognizance of a media report that 8 SIMI under trial prisoners, who escaped from the Bhopal Central Jail were killed in an encounter with police in Bhopal, Madhya Pradesh on the 31st October, 2016.


The Commission has issued notices to the Chief Secretary, Director General of Police and the DG & IG, Prisons, Government of Madhya Pradesh. Calling for detailed reports in the matter within 6 weeks.


The Commission has observed, it has always been concerned about the deaths in police and judicial custody as well as in police action. Specific guidelines have also been issued by it, which have been conveyed to all the States/UTs for compliance in the matters of encounter.

Reportedly, the under trial prisoners escaped the jail after killing a guard. Three of these under trial prisoners had escaped from the Khandwa jail three years back and were nabbed again in the State of Odisha, this year. The under trial were charged under various crimes including murder, sedition, jail break and bank robberies.

As per news report, all escaped prisoners were killed within hours in an encounter at an isolated forested area which is about 15 km from the jail. Senior officers have claimed that the police started firing only after being shot at by the accused. The police team had initially asked the escaped prisoners to surrender, as stated in the report. Five jail officials have been put under suspension including DIG (Jail) and the Jail Superintendent. The Additional DG(Jail) has been reportedly transferred.

A day after eight Simi activists fled the Bhopal Central Jail and were subsequently traced and killed by Madhya Pradesh police in an encounter, the National Human Rights Commission (NHRC) issued on Tuesday notices to the state government+ , police and prison authorities over the killings.
The commission has taken suo motu cognisance of media reports in the matter and observed that it has always been "concerned" about deaths in police and judicial custody as well as in police action. The NHRC has sought detailed reports from MP's chief secretary , director general of police and the director general and inspector general of state prison department.
"The Commission has always been concerned about the deaths in police and judicial custody as well as in police action. Specific guidelines have also been issued by it, which have been conveyed to all the statesUTs for compliance in the matters of encounter," the NHRC said in a statement.
"Reportedly , the under trial prisoners escaped the jail after killing a guard. Three of these under trial prisoners had escaped from the Khandwa jail three years back and were nabbed again in the state of Odisha, this year. Eight Simi activists pulled off a daring prison break and escaped in the wee hours on Monday after killing a security guard at the Bhopal Central jail. Within hours, they were hunted down and killed in an alleged police encounter on the city outskirts.
The incident has kicked up a raging controversy with the government and the opposition parties locked in a war of words over the issue. Raising doubts, Congress and Left parties have sought a judicial probe into the incident.

Transgender people come from all walks of life. We are dads and moms, brothers and sisters, sons and daughters. We are your coworkers, and your neighbors. We are 7-year-old children and 70-year-old grandparents. We are a diverse community, representing all racial and ethnic backgrounds, as well as faith backgrounds.

The word “transgender” – or trans – is an umbrella term for people whose gender identity is different from the sex assigned to us at birth. Although the word “transgender” and our modern definition of it only came into use in the late 20th century, people who would fit under this definition have existed in every culture throughout recorded history.

Despite the increased visibility of transgender celebrities like actress Laverne Cox or writer Janet Mock, many Americans still don’t personally know anyone who is transgender – but the number who do is growing rapidly. According to a 2016 survey by Greenberg Quinlan Rosner Research, commissioned by the Human Rights Campaign, 35 percent of likely voters in the United States “personally know or work with someone who is transgender.” That's more than double the 17 percent who answered yes when asked the same question in 2014.

Other research suggests that there are at least 700,000 transgender people in the United States, about 0.3 percent of the total population and about 3.5 percent of the LGBTQ community; but these estimates are likely conservative because of the limited amount of studies that have attempted to measure the transgender population.

What does it mean to be transgender?
The transgender community is incredibly diverse. Some transgender people identify as male or female, and some identify as genderqueer, nonbinary, agender, or somewhere else on or outside of the spectrum of what we understand gender to be. Some of us take hormones and have surgery as part of our transition, and some don’t. Some choose to openly identify as transgender, while others simply identify as men or women. In many ways, transgender people are just like cisgender (non-transgender) people; but because of the social stigma surrounding our transgender identity, our community faces a unique set of challenges.

What challenges do transgender people face?
While the visibility of transgender people is increasing in popular culture and daily life, we still face severe discrimination, stigma and systemic inequality. Some of the specific issues facing the transgender community are:

 Lack of legal protection : The Supreme Court of India issued a ruling ,recognizing the country's large transgender population as a legal third gender. In so ruling, the court ordered that the government ensure that transgender people are not discriminated against and are eligible for government jobs and education in the same way as it does with other minority groups. It also ordered that the government take steps to promote awareness and to ensure that they are provided with proper medical treatment and public facilities. The landmark two-judge ruling acknowledged the history of marginalization that transgender individuals have faced. "Recognition of transgenders as a third gender is not a social or medical issue but a human rights issue," the opinion stated. India has a long cultural history of recognizing transgender individuals, but their lack of legal recognition has led to discrimination, including prevalent hate crimes.

 Poverty– In too many cases, this lack of legal protection translates into unemployment for transgender people. Transgender are living in severe poverty as Dr. Anthony Raju visited the PUNE and met Punna and Team. As anyone who has experienced poverty or unemployment understands, being unable to afford basic living necessities can result in homelessness or lead people to engage in underground economies like drug sales or survival sex work, which can put people at increased risk for violence and arrest.

 Harassment and stigma– The LGBTQ community still faces considerable stigma based on over a century of being characterized as mentally ill, socially deviant and sexually predatory. While these flawed views have faded in recent years for lesbians and gay men, transgender people are still often met with ridicule from a society that does not understand us. This stigma plays out in a variety of contexts – leaving us vulnerable to lawmakers who attempt to leverage anti-transgender stigma to score cheap political points; to family, friends or coworkers who reject transgender people upon learning about our transgender identities; and to people who harass, bully and commit serious violence against transgender people.

 Identity Documents – The widespread lack of accurate identity documents among transgender people can have an impact on every area of their lives, including access to emergency housing or other public services. To be clear, without identification, one cannot travel, register for school or access many services that are essential to function in society

While advocates continue working to remedy these disparities, change cannot come too soon for transgender people. Visibility – especially positive images of transgender people in the media and society – continues to make a critical difference for us; but visibility is not enough and comes with real risks to our safety, especially for those of us who are part of other marginalized communities.

Bihar Chief Minister Nitish Kumar today announced Rs. 5 lakh award for each of the three soldiers, hailing from Bihar, who were killed in the terror attack at an army base in Uri sector of Jammu and Kashmir.
The Chief Minister also announced that his government would accord full state honour to the three soldiers - SK Vidyarthi, Rakesh Singh and Ashok Kumar Singh - who belonged to the Bihar regiment.
While expressing his sadness over the attack on the army base, Mr Singh said: "The country will always remember their martyrdom."
He also offered his condolences to the families of the three soldiers, adding that the entire state shared their sorrow.
In Boknari village of Gaya, an angry Kiran Devi, the wife of SK Vidyarthi, demanded action against the men who killed her husband. Her daughter Aarti Kumari said that her father died a martyr, and that India must give a befitting reply to Pakistan.
Family members of Rakesh Singh of Nuwan village in Kaimur district and Ashok Kumar Singh of Ara in Bhojpur district remembered the two soldiers with teary eyes and pride in their sense of duty.
The bodies of the three soldiers are expected to reach Patna on Monday evening, from where they would be taken to their respective homes.
The minister in-charge of Kaimur and Gaya district would be present at the cremation of Rakesh Singh and SK Vidyarthi, while the funeral of Ashok Kumar Singh in Ara would be attended by industries minister Jai Kumar Singh.

RIO DE JANERIO: A Deepa did win a medal for India at Rio. It may not have come in gymnastics but it was still a Produnova in its own right. Deepa Malik, a 45-year-old wheelchair-bound adrenaline junkie, from Gurgaon made history when she became the first Indian woman to win a medal at the Paralympics. Her throw of 4.61m won her a silver in the shot put F-53 event.
Deepa's silver extended India's tally at the Rio Paralympics to three medals. Bahrain's Fatema Nedham won the gold medal with a best throw of 4.76m, while Dimitra Korokida of Greece bagged bronze with a throw of 4.28m.
"I want to use this medal to support women with disabilities in India. This journey has been wonderful for me and my entire family. I am proud to be the oldest athlete in the team and win a medal," Deepa was quoted by news agency IANS as saying immediately after she won the medal.
"I don't know whether she was confident of winning a medal but she gave the best performance of her life," daughter Devika told TOI after the news came in, adding, "I haven't spoken to her after the event, but we had seen her work hard for the Games and we are happy that that hard work resulted in a medal."
The silver medal will be the icing on the cake for Deepa, also the first Indian woman to participate at the Paralympics, but it comes on the back of a dazzling array of swimming and javelin efforts for the paraplegic, who has been paralysed from the waist down after a spinal tumour in 1999, followed by three surgeries and 183 stitches, made walking impossible.
A former Rajasthan state women's cricketer, Deepa's first love remains biking. Deepa Malik once claimed she had gotten married at 20 because her husband supported her love for bikes. Despite her current condition, she became the first paraplegic woman in the world to ride a quad bike across nine high-altitude passesin nine days on Ladakh's motorable roads. In 2013, she participated in a Chennai-Delhi (3,278km) panIndia drive by paraplegic women.
That's not all. In 2008, Deepa created another record when she swam the Yamuna for a kilometre upstream.Four years later, she was awarded the Arjuna Award for her swimming performances. In all, she has 17 international medals, 58 National gold medals, she holds the Asian record in javelin throw and also has World Championship silver medals in shot put and discus in 2011.
Today , a mother of two and wife of an Army officer, Deepa is a vocal spokesperson for paraplegic rights in the country with her Ability Beyond Disability movement.

Alarming numbers of migrant children in Greece are being detained in deplorable and depraved conditions , Human Rights Watch says.

Unaccompanied minors – some as young as 14 – are being held in substandard and chaotic detention centres across the country in flagrant violation of international and Greek law, the group said in a report on Friday.

“Children are being detained for weeks and months, and are being made to live in filthy, bug-and-vermin-infested cells, sometimes without mattresses or access to showers,” said Rebecca Riddell, who authored the report.

Speaking from New York, Riddell told the Guardian the 27-page investigation – entitled “Why are you keeping me here?”– documented indisputably that children were being held for prolonged periods in places where they had little access to basic care and services.

“The conditions are really shocking and often worse in police stations than detention centres,” said Riddell, a Europe fellow at Human Rights Watch. The report, she added, was based on visits to police stations and detentions centres on the mainland and 42 interviews with children who were or had been detained.

“This isn’t a new problem but it is being made much worse by significant migration to Greece and callous inaction by EU countries … We’re talking about kids who are all alone and who fled their countries, often to escape violence.”


Migration crisis: Greece plans new shelters to reduce overcrowding on islands Counselling, information and legal aid were virtually non-existent along with psychological care or even access to interpreters.

Greek police detained 161 unaccompanied children in the first six months of 2016, according to official data. Authorities have long argued that alternatives to detention, in the form of child-friendly shelters, simply do not exist, although private philanthropic organisations are working around the clock to fill the gap.

More than 3,300 unaccompanied asylum-seeking and other migrant children were registered by local authorities between January and July this year. Under the weight of the numbers, and with the overburdened shelter system full to brimming, Greek police say they are necessarily compelled to place children in so-called protective custody until suitable accommodation is found.

But in its excoriating indictment of the situation, Human Rights Watch said the children were often incarcerated for much longer than the 25-day period that Greek law permitted, pending transfer to a shelter, as a measure of last resort.

Greece resumes migrant deportations to Turkey

“Greece should end the unjustified detention of unaccompanied children and ensure they have suitable accommodation,” said Riddell. “The EU should not only support those efforts but accommodate the transfer of unaccompanied children from Greece to other EU countries through relocation and family reunification.”

In a visit to Greece two weeks ago, the UN High Commisioner for Refugees, Filippo Grandi, spoke openly of the risk migrant children now faced.

“Unaccompanied minors are extremely exposed to exploitation of many kinds and in particular sexual exploitation,” he said in Athens. “There is a lot of survival sex that is happening, there is sexual harassment and sexual abuse. I think that this is something we cannot tolerate, in particular in the European Union.”

Former Delhi minister for women and child development, Sandeep Kumar is allegedly involved in a sex scandal. What is this scandal, what is being alleged and by whom? Nobody is sure about it. As of now the facts are like this — a CD appeared in Delhi Chief Minister Arvind Kejriwal’s mail which contained ‘objectionable’ visuals of a half-dressed Sandeep Kumar with two women. There is no mention of any violence in the video or exchange of cash transaction.

When was the CD made, when did it reach Kejriwal and how, what is the location of the events, who are the women – none of these facts are established yet. The CD was anonymously dropped at Kejriwal’s office. Media is calling the anonymous person a whistle-blower. Usually whistle-blowers expose corruptions and scandals by making considerable evidence public. In this case, all we got is a CD with nine minutes of visuals without any context. The person probably has explored all means by which more damage could have been caused but found none. As such, nobody has come forward to allege any crime of rape, force, coercion, corruption, cheating or adultery.
Visuals of a man with women other than his wife in compromising positions by itself is not a scandal unless somebody reports a crime or files any kind of complaint with any authority, seeking any kind of justice.
Yet the nation is morally outraged at the mere fact that a man had sex. Because sex is against our culture and we all fall from trees. Media is doing all kinds of sleazy speculations and with each speculation outrage level increases with dramatic sound effects. There were two women. Horror! The minister himself was recording the video. Double horror! My naïve nation doesn’t know that recording consensual act of love making can become quite a pleasurable activity.
For all we know, there is some role playing and voyeurism going on, might be even with the consent and active participation of the wife. I am just saying anything is possible in this 'sanskari' nation.
The outrage is double because the man was in charge of the women and child ministry. Had he been transport minister or something it would have perhaps been understandable. But, if you care for women’s issues, you have to be morally superior and should not have kinky sex. Women’s body here once again is an area of contestation for the nation. We are moral vigilantes and we do it for the nation’s women.
Outrage is triple because apparently the former minister committed a crime of adultery against the wife and the nation is weeping for the plight of the poor woman. Dear nation, before you reach the third level of moral outrage, please know that even if you prove adultery it doesn’t benefit the woman. It only establishes a man’s right over a woman’s body. Unlike rape or domestic violence, adultery is not a crime committed against women. It is committed by one man against another man. The adultery law treats married women as their husband’s chattel. It gives the husband the right to establish his ownership over the wife’s body (his chattel)and punish whoever uses the chattel. The chattel’s consent here is not required. The chattel also cannot bring charges of adultery against her owner (husband).

Section 497 of Indian Penal Code defines adultery as—"Whoever has sexual intercourse with a person who is and whom he knows or has reason to believe to be the wife of another man, without the consent or connivance of that man, such sexual intercourse not amounting to the offence of rape, is guilty of the offence of adultery, and shall be punished with imprisonment of either description for a term which may extend to five years, or with fine, or with both. In such case the wife shall not be punishable as an abettor."
It is a non-cognizable and bailable offense, which means police cannot act on its own unless somebody comes and files an FIR but police may grant bail on its own without taking the matter to the magistrate.
The charge of adultery is similar to charges of somebody stealing fodder. Why did your cattle graze in my farm? Why did you steal fruit from my orchard? Why did you have sex with my wife? The operative words are ‘wife of another man’ and ‘without consent or connivance of that man’.
A married woman is a man’s property. He can stop other men from having an affair with her. In the present case, AAP MLA's wife does not have any locus standi to bring a case against him. Only the husband of the women involved in sex tape can bring a case of adultery. Is the nation so concerned about the obscure man's rights? But she has no right to stop her husband from going out and having sex with other women. Adultery law in India is one of the most regressive laws and goes against everything women’s movement has ever fought for — dignity, individuality and the basic right to be treated as human beings.
It is a shame that self-appointed custodians of women’s sexuality are shedding crocodile tears for so called ‘poor woman’ raising crime of adultery. So please dear nation, you may have a right to be morally outraged at whatever you wish, but please don't do it in women’s name. My body or my honour is just mine, not of the nation to be outraged about.

Supreme Court on Monday sought explanation from Uttar Pradesh minister and Samajwadi Party leader Azam Khan for calling Bulandshahr gangrape a ‘political conspiracy’.
Earlier in the month, Azam Khan had said that the Bulandshahr gangrape incident was a political conspiracy to defame the government. He said that with the elections near the desperate opposition could stoop to any level. “We must also probe whether this entire controversy is a move by some Opposition elements to defame the government. People who want to come to power may be stooping this low for political interests,” the minister said.
Following his remarks, the minor victim in the case had also moved the apex court seeking FIR against Khan and erring police officers.

The incident took place, on July morning, when a Noida-based private sector employee, his wife, two daughters and two other male relatives were on their way to attend a funeral in Shahjahanpur, when their vehicle was stopped near Dostpur village on NH-91 at around 2:30 am. The family told the police that the road had been blocked with an “iron rod”, due to which they were forced to stop the vehicle.
As soon as they had stopped the vehicle, about half-a-dozen armed dacoits had reportedly surrounded them. According to the FIR, the dacoits had forced the family to walk into the thickets, about 50 metres from the highway, and looted their cash, jewellery, ATM cards and other valuables. They then had allegedly dragged the woman and her daughter some distance away and raped them, while holding the male members of the family at gunpoint.

The incident took place in the morning when the locals found Dana Majhi carrying his wife Amang Dei's body. The 42-year-old woman died of tuberculosis on Wednesday night at the district headquarters hospital at Bhawanipatna. Majhi was quoted by the BBC saying that his village was 60km (37 miles) away and he couldn't afford to hire a vehicle.
The hospital staff took no responsibility for the event, when they said that Dei had died on Tuesday night and that Majhi had taken away the body without informing the hospital. However Majhi denied the statement and alleged that he began walking with the body after the hospital staff pushed him to remove it.
In Odisha, for those in such a situation, the Naveen Patnaik government launched the 'Mahaparayana' scheme in February, offering free transportation of bodies from government hospitals to the residences of the deceased.
Majhi, however, said despite his all-out efforts, he could not get any help from the hospital authorities. He wrapped his wife's body in cloth and started walking to his village Melghara in Rampur block.

Majhi's daughter accompanied him till some local reporters spotted the duo. They called up the district collector and arranged for an ambulance for the remaining 50 km of the journey.
"I told the hospital authorities that I am a poor man and cannot afford a vehicle. Despite repeated requests, they said they cannot offer any help," Majhi told a local television channel.
Kalahandi District Collector Brunda D said, "As we got to know of the incident, we spoke to the CDMO and arranged for an ambulance.
"I have issued instructions to the Tehsildar to provide assistance under the Harishchandra Yojana (Assistance to the poor and destitute to perform last rites). I have also asked the BDO to provide assistance from Red Cross and CMRF," she said.
The Indian Express quoted her saying, “We would have surely sent the body in a vehicle,” adding that she has sanctioned for Rs 2,000 for Majhi from the Odisha’s funeral assistance scheme and another Rs 10,000 from the District Red Cross Fund.
As per the 'Mahaparayana' scheme, dead body carriers are supposed to be deployed at 37 government hospitals and a total of 40 vehicles were assigned for the job.
According to a report by The Indian Express, this is not the first time when people have to resort to such methods for transporting bodies. In May, two youths had rode with the body of their relative from Jharigan Community Health Centre to Bharuamunda village which is almost 30 kms away. They too didn't have enough money to arrange a vehicle.

Reaching out to the people in Kashmir, the Centre on Sunday said it wanted to have emotional ties with them and not a need-based relationship and expressed the willingness to talk to whosoever needed once peace and normalcy is restored in the Valley.
Winding up his two-day visit to Kashmir in the backdrop of widespread disturbances that has claimed 46 lives so far, Union Home Minister Rajnath Singh said security forces have been directed to refrain from using pellet guns against crowds as much as possible even as he awaits a report of a committee set up by him to look into the use of non-lethal weapons.
During his stay in the Valley, Rajnath met 30 delegations including a government team led by Chief Minister Mehbooba Mufti and an opposition National Conference(NC) team headed by Omar Abdullah. The Congress stayed away from deliberations with the Home Minister.
In a memorandum submitted to the Home Minister, the NC asked the Centre to initiate a sustained dialogue with Pakistan as well as separatists groups in Jammu and Kashmir for evolving a consensus for a mutually acceptable solution to the political issue.
Sending a strong message to Pakistan at a press conference at the end of his visit to Srinagar and Anantnag, Rajnath warned the neighbouring country not to interfere in India’s internal affairs and that it should change its attitude and approach towards Kashmir. “There is no need of any third force to improve situation in Kashmir. Pakistan’s role is not ‘paak’ (pure) towards Kashmir.”
“As far as Government of India is concerned, I want to make it clear that we don’t just want need-based ties, but to build an emotional relationship with Kashmir,” he said, reaching out to the people in the Valley while making a fervent appeal to them to help restore peace and normalcy in the state.
Rajnath said the Centre will talk to whosoever needed once peace and normalcy is restored in the state.
To a question on whether there will be any talks with separatists, Singh said, “Let normalcy and peace be restored first. We will talk to the chief minister here and we will work only after taking her into confidence. Let us first ensure that normalcy returns. Then, we will talk to whoever we want.”
He said the government would review the use of pellet guns and a committe has already been set up by him to look into the use of non-lethal weapons which will give its report in two months.
“The difference of opinion can be resolved through talks as there can be no other solution,” Rajnath said, adding, problems cannot be solved in short of span of time. “Problems cannot be solved in 15 days or one month. It will take time.”
“If there are any differences or disapprovals, they can be resolved through talks mutually. Because, there cannot be any other solution. I feel that if there is place of Kashmiriyat in democracy, it will only be of humanity,” he said, adding that the people of the entire country want that Kashmir should once again become “firdaus” (paradise),” he said.
Expressing sympathy with those injured during the ongoing unrest in the Valley, Singh appealed to the youth to desist from indulging in stone pelting.
“I appeal to the youth of Kashmir not to indulge in stone pelting and security forces should avoid use of pellet guns as far as possible,” he said.
Rajnath said Prime Minister Narendra Modi is concerned about the situation in Kashmir and wanted the situation to improve as soon as possible.
“I am very concerned at the situation in Kashmir and our Prime Minister is also very concerned over it. Along with expressing regret over what happened here, I offer my condolences to the families of all those who lost their lives. The Prime Minister spoke to me last night and discussed the situation (in Kashmir). He also wants that the situation should improve,” he said.
Rajnath expressed regret over the loss of life during the ongoing unrest in Kashmir, saying the Centre was open to any constructive suggestions for improving the situation in the Valley.
“I appeal to all Kashmiris to come forward with constructive suggestions for improving the situation in Kashmir,” he added.
On revocation of Armed Forces Special Powers Act (AFSPA) from the state, the Home Minister said whatever has to be done on the issue will be done in consultation with the state governments.

On his two-day visit, Rajanth said he met 30 delegations during which he got information and suggestions on how to restore peace and normalcy in the Valley.
“I also visited Anantnag and heard the people there for one hour. I appealed to people of Anantnag also to maintain calm and help in restoring peace and normalcy,” he said.
Replying to a question if India will hold talks with Pakistan over Kashmir, the Home Minister there was no need for involvement of a third power.
“There is no need of any third force to improve situation in Kashmir. Pakistan should not interfere in internal matters of India,” he said.
Hitting out at Islamabad, Singh said while Pakistan was itself struggling with terrorism, it was arming the youth of Kashmir with guns.
“I want to tell the neighbouring country that you are suffering from terrorism. You attacked Lal Masjid (in Lahore) to kill terrorists but you are sending guns for youth of Kashmir. This should stop,” he said, asserting that the government will not tolerate terrorism in any form.
